Eligibility


To qualify for debt relief under Chapter 7 of the Bankruptcy Code, a debtor can be an individual or a business entity. Subject to a "means test" for individual debtors, relief is available for individuals under Chapter 7 regardless of the amount of debt, with certain exceptions. Individual must qualify via a "means test" based on their income and family size. Individuals must also received credit counseling from an approved credit counseling agency before and after filing a petition for relief, with exceptions in emergency situations.
